Brevard Settlement Clears Way for Homes, Marina on Merritt Island

Brevard County will pay three million dollars to settle a long-running lawsuit tied to development limits on North Merritt Island. County commissioners unanimously approved a tentative agreement allowing up to 84 single-family homes and a potential 42-slip marina. In return, the county will acquire nearly 150 acres for stormwater control, conservation, and possible public access, aimed at reducing runoff into the Indian River Lagoon. The dispute dates back to a 2009 comprehensive plan change that cut development density, prompting a lawsuit filed in 2014 by the property owner. County documents say the changes reduced the land’s value and development potential. If approved by circuit court, the deal ends claims alleged to exceed four million dollars while restoring development rights and expanding flood control infrastructure.
